Introduction
As per decree 152/2020/ ND-CP detailing the articles of the labour code on the management of foreign nationals working in Vietnam, all relevant companies are required to report on the use or employment of foreign nationals in Vietnam twice a year. The semi-annual report is next due 5th January 2025.

What has changed?
Applicable organisations are requested to submit to the Department of Labour, War Invalids and Social Affairs reports on their employment of foreign workers twice annually. The mandatory semi-annual report is now due by 5th January 2025.
All registered entities in Vietnam sponsoring foreign nationals must complete this process. The report is to include details of foreign nationals who have been working in Vietnam during the period starting December 15, 2023 to December 14, 2024.
What to expect /impact?
Failure to meet the reporting requirements may result in administrative fines, as outlined in Decree 12/2022 on administrative labor violations. It could also potentially lead to delays in obtaining approvals for future foreign labour demands and work permit applications.
