Indonesia: increased compliance action

Introduction

The Indonesian government has been conducting an increased number of random audits. As a result of which, the government have reminded both foreign nationals within Indonesia and their sponsoring companies of their compliance obligations.

What has changed?

Foreign nationals are reminded that they must provide complete information to the immigration department and must report any changes in civil status, citizenship, employment, guarantor, or address within 30 days of the change to the immigration department. 

Sponsoring companies should ensure that their employees abide by the above. If they fail to do so, a warning letter will be issued to the company. If the company fails to comply within 30 days of the letter, they may be subject to sanctions.

In addition, a foreign national employee’s job title must be consistent with that on their permit. When renewing their permit, a foreign national employee must verify that their job title and address match the details on their current ITAS.

Further to this, if a company changes its name, all foreign employees must update their sponsorship within 30 days to reflect the new company name. Companies should also ensure that any changes in their Board of Directors or Commissioners are reported.
